1. Concept of C/O form AI
C/O form AI is a preferential C/O type issued for goods originating from Vietnam when exported to India and ASEAN member countries based on the AIFTA multilateral trade agreement.
hAIFTA Agreement, also known as ASEAN-India Free Trade Agreement. The agreement was signed between ASEAN member states and India on August 13, 2009. (According to Association of Southeast Asian Nations – ASEAN)
Exported goods, after being issued C/O form AI, will receive incentives under the goods trade agreement under the framework agreement on comprehensive economic cooperation between ASEAN member countries and the Indian government. .
2. Application for C/O form AI
- Application for issuance of C/O. This is a pre-existing form, you just need to fill in all the necessary information that this form requires. This form must be signed and stamped by the business requesting the C/O for the document to be legal.
- Fill out C/O Form AI. You need to fill out C/O form AI for goods exported to India. The dossier set will have a total of 3 copies, 1 original, 2 copies will be sent to C/O issuing organizations for storage. During the process of filling out the C/O form, you must type completely and accurately the information boxes on the form and use English for presentation. All copies must be marked in red and signed by an authorized person.
- Commercial invoice. Commercial invoice has the English name Commercial Invoice. This is a document that needs to be circulated as an original and issued by businesses carrying out import and export.
- Customs declaration. The customs declaration must include documents with a red seal and a confirmation signature of a competent person at the enterprise. At the same time, a copy of the original copy is also required. In some cases where there is a valid reason, you can submit the customs declaration later.
- Copy of bill of lading. With this document, you only need a notarized copy if the exporter does not have the original in hand.
- Calculation of value content by region. The calculation information and values contained in this spreadsheet are based on that area and the current time (time of document preparation).
- Detailed list of input materials. These are documents related to materials used to produce exported goods. Valid documents can be copies of raw material purchase contracts or invoices related to the purchase of raw materials to produce goods. If you do not have the above contract or invoice, you will need confirmation from the party selling the materials to you.
- Customs copy of imported raw materials, copy of production process for exported goods and some other types of documents. In some cases, C/O-issuing agencies and organizations will require additional documents such as: original Packing list, Bill of Lading, customs declaration of imported goods, explanation of production process...
3. Cases where C/O form AI is rejected
In some cases you will be refused a C/O form AI. Usually the reason will be related to the information you provide in your profile. This is why you need to prepare your application carefully. Below are some common reasons for C/O refusal:
- The application for C/O form AI is incorrect
- Debt of incomplete documents from the previous C/O application
- There are issues related to fraud during the C/O application process and these issues have not yet been resolved.
- Failure to prepare required documents.
- The contents of the C/O application dossier are inconsistent and contradictory.
- Information declared in red ink or handwritten, with erased characters...
- Unable to prove the origin of exported goods.
