Procedures for expanding, shrinking, moving, transferring ownership of duty-free shops

– Investment Law No. 67/2014/QH13 dated November 26, 2014;

– Law amending and supplementing Article 6 and Appendix 4 on the list of conditional investment and business sectors of the Investment Law No. 03/2016/QH14;

– Decree No. 68/2016/ND-CP dated July 1, 2016 of the Government regulating conditions for duty-free goods business, warehouses, locations for customs procedures, gathering, inspection and supervision custom;

– Decree No. 67/2020/ND-CP dated June 15, 2020 Amending and supplementing Decree No. 68/2016/ND-CP dated July 1, 2016 of the Government

+ Prepare a set of documents as prescribed in Article 9 of Decree No. 68/2016/ND-CP dated July 1, 2016 of the Government.

+ Send to the General Department of Customs by post or send directly or through the electronic data processing system of the customs authority.

+ Modify, supplement and complete documents: In case there are not enough valid documents, within 05 working days from the date of receiving the enterprise's documents, the General Department of Customs will notify in writing and request the enterprise to supplement the documents. More than 30 working days from the date of sending the notice but the enterprise has not respondedOhibuhg text, TdriveThe Customs Department has the right to cancel documents.

Step 2: Customs agency Carry out inspection of customs records, physical inspection of duty-free shops and duty-free warehouses:

+ Receive and check dossiers requesting expansion, contraction, relocation, or transfer of ownership of duty-free shops, and dossiers for amendments and supplements (if any).

+ Physical inspection of duty-free shops and duty-free warehouses

+ Notify the business in writing when the records or actual duty-free shops or duty-free warehouses do not meet the requirements.

+ Issuing permission to expand, reduce, move, or transfer ownership of duty-free shops in cases where regulatory requirements are met.

In case of expansion, contraction, and move:

– Written request for expansion, contraction, relocation, or transfer of ownership of duty-free shops according to form No. 01, appendix issued with Decree No. 67/2020/ND-CP dated June 15, 2020: 01 original;

–  Diagram of expansion, contraction, and relocation areas: 01 photocopy.

– Documents proving the right to use expansion, contraction, or relocation: 01 copy;

In case of transferring ownership of duty-free shops:

– Written request for a certificate of eligibility to trade duty-free goods according to form No. 01 appendix issued with Decree No. 67/2020/ND-CP dated June 15, 2020: 01 original copy;

– Business registration certificate or Investment certificate or other documents specified in Clause 4, Article 81 of Decree No. 78/2015/ND-CP dated September 14, 2015 of the Government on business registration: 01 photocopy.

–  Area design diagram, duty-free store location, camera system installation location: 01 photocopy.

– Certificate of satisfaction of fire prevention and fighting conditions issued by the police agency (except for cases located in areas that have been recognized to meet fire prevention and fighting conditions: 01 photocopy.

– Application for transfer of ownership: 01 original copy;

– Contract related to transfer of ownership: 01 copy.
