Customs procedures for goods in transit from ASEAN member countries through the territory of Vietnam to other ASEAN member countries

– Customs Law 2014;

– Article 13 of Decree No. 46/2020/ND-CP dated April 9, 2020 of the Government Regulating customs procedures, customs inspection and supervision for goods in transit through the Customs Transit System ASEAN to implement Protocol 7 on the Customs Transit System.

a) At the Customs Branch of the import border gate (Transit Customs Branch)

Step 1: The customs declarant presents customs documents and goods to the Customs Branch of the import border gate (Transit Customs Branch) for inspection at the request of the customs authority;

Step 2: Import border gate customs branch receives documents; Check the status of goods; Check customs seals or special seals for goods in transit of priority businesses.

Step 3: The Customs Branch at the import border gate checks customs records and physically inspects goods in cases where the shipment must have customs records checked and physically inspected.

Step 4: The Customs Branch of the import border gate monitors and coordinates with the Customs Branch of the export border gate (Transit Customs Branch) to handle abnormalities that occur during the transit of goods according to regulations;

Step 5: The customs department at the import border gate confirms that the goods in transit have crossed the border into Vietnamese territory through the ACTS System.

b) At the Export Border Gate Customs Branch (Transit Customs Branch):

Step 1: The customs declarant presents customs documents and goods to the Customs Branch at the export border gate for inspection at the request of the customs authority;

Step 2: The customs branch at the export border gate receives documents; Check the status of goods; Check customs seals or special seals for goods in transit of priority businesses.

Step 3: The Customs Branch at the export border gate checks customs records and physically inspects goods in cases where the shipment must have customs records checked and physically inspected.

Step 4: Export border gate customs branch monitors and coordinates with relevant agencies (guarantee agency, import border gate customs, transit country customs and destination country customs) to handle abnormalities occurs during the transit of goods according to regulations.

Step 5: The customs department at the export border gate confirms the goods crossing the border through the ACTS System.

a) TAD documents (in case the ACTS System has a problem, there must be confirmation from the customs authorities of ASEAN countries participating in the transit goods transport journey);

b) Goods transit permit in case Vietnamese law requires a goods transit permit: 01 original copy;

c) Notification of quarantine results of the quarantine agency meeting the requirements according to the provisions of law on quarantine or quarantine documents issued by foreign quarantine agencies and recognized by the law on quarantine for In case goods in transit must be quarantined: 01 original copy.
