Pursuant to clause 1, clause 2 and Clause 3 Article 56 Decree 08/2021/ND-CP Regulating electronic procedures for Vietnamese and Cambodian inland waterway vehicles entering Vietnamese inland waterway ports as follows:
– At least 02 hours before the vehicle is expected to arrive at the border gate, the person doing the procedures must declare documents electronically through the National Single Window Information Portal, including:
a) Notify the vehicle's arrival at the inland waterway port according to Form No. 48 in the Appendix issued with this Decree;
b) Permit to leave an inland waterway port according to Form No. 39 in the Appendix issued with this Decree;
c) General declaration according to Form No. 40 in the Appendix issued with this Decree;
d) List of crew members according to Form No. 41 in the Appendix issued with this Decree;
d) Passenger list according to Form No. 42 in the Appendix issued with this Decree;
e) Goods declaration according to Form No. 43 in the Appendix issued with this Decree or shipping contract or warehouse invoice or shipping document;
g) Plant quarantine declaration for goods subject to plant quarantine according to Form No. 44 in the Appendix issued with this Decree;
h) Animal quarantine declaration for goods subject to animal quarantine according to Form No. 45 in the Appendix issued with this Decree;
i) Declaration of weapons and explosives (if any) according to Form No. 46 in the Appendix issued with this Decree;
k) Declaration of stowaways on board (if any) according to Form No. 47 in the Appendix issued with this Decree.
– Documents must be presented
a) Documents presented to the Port Authority include: Certificate of technical safety and environmental protection of the vehicle, documents related to goods transported on the vehicle, vehicle registration certificate (or copy copy certified by a credit institution in case the vehicle is pledged or mortgaged), certificate of professional ability, professional certificate of crew members, vehicle driver, copy of insurance certificate civil liability (for vehicles required to have civil liability insurance), water transport license across the Vietnam - Cambodia border;
b) Documents presented to the Customs Authority: Documents related to goods transported on the vehicle;
c) Documents presented to the Border Guard at the border gate: Passport and valid international travel documents of crew members and passengers (if any);
d) Documents presented to the plant quarantine agency: Plant quarantine certificate (for goods subject to plant quarantine);
d) Documents presented to the animal quarantine agency: Animal quarantine certificate of the exporting country (for goods subject to animal quarantine);
e) Documents presented to the health quarantine agency: International vaccination certificate of crew members, vehicle drivers, and passengers (in case of departure from or passing through an epidemic area or suspected of having the disease or infectious agents).
– Check documents related to vehicles and crew members
a) The port authority checks declared information and looks up data of Vietnamese vehicles and crew members on the electronic database of competent agencies to handle licensing procedures for vehicles entering the port. inland waterways;
b) The port authority only requires the person carrying out procedures to submit and present documents in cases where the database does not have information on the vehicle, crew, or driver or there is not enough electronic data to check. , compare or do not ensure the conditions of electronic documents and the person doing the procedures only declares data for the first time about the vehicle and crew on the electronic software (chosen by the person doing the procedures). The port authority first checks and compares the declared data with the original presented to handle procedures for vehicles entering inland waterway ports or when there are changes. The database of crew members, vehicle drivers, vehicles, and inland ports is kept on the National Single Window Portal to serve as a database for subsequent procedures;
c) Time limit for presenting documents not in the database: No later than 02 hours from the time the vehicle has anchored at the wharf or 04 hours since the vehicle has anchored at another location in the port waters inland.
Responsibility for carrying out procedures of specialized state management agencies at inland waterway ports according to legal regulations
Base Clause 4 Article 56 Decree 08/2021/ND-CP stipulates as follows:
– Responsibility for carrying out procedures of specialized state management agencies at inland waterway ports
a) The Port Authority is responsible for checking the documents specified in Points a, b, c, d, dd, e Clause 1, Point a Clause 2 of this Article; is primarily responsible for and has the authority to make the final decision on the documents specified in Points a, b, c, Clause 1 of this Article, in cases where state management agencies participate in processing and have opinions. different;
b) The Customs authority is responsible for checking the documents specified in Points a, c, d, dd, e, Clause 1 of this Article; Take main responsibility and have the authority to make the final decision on the documents specified in Point b, Clause 2 of this Article in case state management agencies participate in the processing and have different opinions;
c) The Border Guard at the border gate is mainly responsible for checking the documents specified in Points a, b, c, d, dd, i, k Clause 1, Point c Clause 2 of this Article and has the authority to decide Final decision for the documents specified in Points i, k, Clause 1, Point c, Clause 2 of this Article, in case state management agencies participate in the processing and have different opinions;
d) The plant quarantine agency is responsible for checking the documents specified in Points c and g, Clause 1, and Point d, Clause 2 of this Article; take main responsibility and have the authority to make the final decision on the documents specified in Point g, Clause 1 of this Article, in case state management agencies participate in the processing and have different opinions;
d) The animal quarantine agency is responsible for checking the documents specified in Points c and h, Clause 1, Point dd, Clause 2 of this Article; take main responsibility and have the authority to make the final decision on the documents at Point h, Clause 1 of this Article, in case state management agencies participate in the processing and have different opinions;
e) The health quarantine agency is responsible for checking the documents specified in Point e, Clause 2 of this Article and has the authority to make the final decision on the checked documents in cases where state management agencies jointly Participate in processing and have different opinions.
Time to carry out electronic licensing procedures
In Clause 5 Article 56 Decree 08/2021/ND-CP Specific regulations are as follows: No later than 30 minutes from the time the person completing the electronic declaration procedures and presenting all required documents, based on feedback from the agencies. Relevant authorities, the Port Authority issues electronic permits for vehicles entering inland waterway ports through the National Single Window Information Portal.
