Procedures for recognition of warehouses and locations in seaports, inland waterways ports, international airports, and international railway stations as eligible for customs gathering, inspection and supervision

– Investment Law No. 67/2014/QH13 dated November 26, 2014;

– Law amending and supplementing Article 6 and Appendix 4 on the list of conditional investment and business sectors of the Investment Law No. 03/2016/QH14;

– Decree No. 68/2016/ND-CP dated July 1, 2016 of the Government regulating conditions for duty-free goods business, warehouses, locations for customs procedures, gathering, inspection and supervision custom;

– Decree No. 67/2020/ND-CP dated June 15, 2020 Amending and supplementing Decree No. 68/2016/ND-CP dated July 1, 2016 of the Government

+ Prepare a set of documents as prescribed in Clause 21, Article 1 of Decree No. Decree No. 67/2020/ND-CP dated June 15, 2020 of the Government

+ Send to the General Department of Customs by post or send directly or through the electronic data processing system of the customs authority.

+ Modify, supplement and complete documents: In case there are not enough valid documents, within 05 working days from the date of receiving the enterprise's documents, the General Department of Customs will notify in writing and request the enterprise to supplement the documents. Step 2: Customs agency Carry out customs document checks and inspections warehouses, locations in seaport areas, inland waterway ports, international airports, and international railway stations that are eligible for customs gathering, inspection, and supervision:

+ Receive and check documents requesting recognition warehouses, locations in seaport areas, inland waterway ports, international airports, and international railway stations that are eligible for customs gathering, inspection, and supervision, records of amendments and supplements (if any).

+ Physically check the location

+ Notify the business in writing when documents or actual warehouse or location do not meet the requirements.

+ Issuance of recognition certificate warehouses, locations in seaport areas, inland waterway ports, international airports, and international railway stations that are eligible for customs gathering, inspection, and supervision in cases where regulatory requirements are met.

– Document requesting recognition of warehouses and locations in seaport areas, inland waterway ports, international airports, and international intermodal railway stations that are eligible for gathering, inspection, and customs supervision according to Form No. 01 Appendix issued with Decree No. 67/2020/ND-CP dated June 15, 2020 of the Government: 01 original copy;

– Business registration certificate or Investment certificate or other documents specified in Clause 4, Article 81 of Decree No. 78/2015/ND-CP dated September 14, 2015 of the Government on business registration: 01 photocopy.

– Design diagram of warehouse area, location in seaport area, inland waterway port, international airport, international railway station eligible for gathering, inspection and customs supervision: 01 photocopy.

– Decision announcing the opening and establishment of seaports, inland waterway ports, international airports, and international intermodal railway stations of the competent authority: 01 photocopy.
