Circular No. 37/2022/TT-BCT 2022 regulating Rules of Origin of goods in the ASEAN-Japan Comprehensive Economic Partnership Agreement

On August 24, 2022, the Joint Committee implementing the Comprehensive Economic Partnership Agreement between ASEAN and Japan adopted the Product Specific Rules (PSR) converting from HS 2002 to HS 2017 and amending the Rules implemented in the Implementation Rules (under Appendix 4 of the ASEAN-Japan Comprehensive Economic Partnership Agreement).

To implement international commitments on Rules of Origin in the ASEAN-Japan Comprehensive Economic Partnership Agreement, on December 23, 2022, the Ministry of Industry and Trade issued Circular No. 37/2022/TT-BCT Regulating the Rules of Origin of Goods in the ASEAN-Japan Comprehensive Economic Partnership Agreement, annulling Decision No. 44/2008/QD-BCT dated December 8, 2008 of the Minister of Industry and Trade promulgating the Regulations Issue Certificate of Origin Form AJ to enjoy incentives under the ASEAN-Japan Comprehensive Economic Partnership Agreement.

The Circular includes Chapter IV, 36 Articles and 5 attached Appendices, specifically:

– Chapter I: General regulations.

– Chapter II: Rules of origin of goods.

– Chapter III: Certification and inspection of goods origin.

– Appendix IV: Implementation provisions.
