Three more countries are subject to preferential import and export taxes under the CPTPP Agreement

According to Decree No. 68/2023/ND-CP recently issued by the Government, adding Malaysia, Chile and Brunei to apply Vietnam's preferential export tax and special preferential import tax to implement the Partnership Agreement. Comprehensive and Progressive Trans-Pacific period 2022-2027.

The Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP Agreement) was signed on March 8, 2018 in Santiago (Chile) and approved by the National Assembly in Resolution No. 72/2018/QH14.

The agreement has entered into force for Australia, Canada, Japan, Mexico, New Zealand, Singapore and Peru.

The Government issued Decree No. 115/2022/ND-CP dated December 30, 2022 promulgating Vietnam's Preferential Export Tariff and Special Preferential Import Tariff to implement the CPTPP Agreement in the 2022 period. -2027, and applies to countries including Australia, Canada, Japan, Mexico, New Zealand, Singapore and Peru.

Therefore, on September 7, 2023, the Government issued Decree No. 68/2023/ND-CP amending and supplementing a number of articles of Decree No. 115/2022/ND-CP dated December 30/ 2022 of the Government promulgating the Preferential Export Tariff and Special Preferential Import Tariff of Vietnam to implement the CPTPP Agreement for the period 2022-2027.

Decree No. 68/2023/ND-CP adds Malaysia, Chile and Brunei to apply Vietnam's preferential export tax and special preferential import tax to implement the CPTPP Agreement for the period 2022-2027.

Decree No. 68/2023/ND-CP takes effect from the date of signing (September 7, 2023).

Decree No. 68/2023/ND-CP clearly states, for customs declarations of goods exported from Vietnam to Malaysia or imported into Vietnam from Malaysia registered from November 29, 2022 to before September 7, 2023; for customs declarations of goods exported from Vietnam to the Republic of Chile or imported into Vietnam from the Republic of Chile registered from February 21, 2023 to before September 7, 2023; For customs declarations of goods exported from Vietnam to Brunei or imported into Vietnam from Brunei registered from July 12, 2023 to before September 7, 2023, if all conditions are met to enjoy preferential export tax and special preferential import tax prescribed in Decree No. 115/2022/ND-CP dated December 30, 2022 of the Government, Decree 68/2023/ND-CP and have If you pay tax at the higher tax rate, the Customs authority will handle the overpaid tax according to the provisions of law on tax administration./.
