Ships operating on domestic routes that carry imported goods, goods in transit or have passengers or crew members with foreign nationality enter a seaport and ships that have subsequently entered another seaport of Vietnam

1. Procedure:

a) Submit administrative procedure documents:

– Notification of ship arrival at port: Before the ship arrives at the expected port location, the person carrying out procedures shall send the following information to the Maritime Authority where the ship arrives:

+ Notification of ship's arrival at seaport (according to the General Declaration form): At least 08 hours before the ship arrives at the expected destination of the port; In case ships move between Vietnamese seaports or maritime areas not exceeding 20 nautical miles, at least 02 hours before the ship arrives at the port destination. Ships, military ships, ships with engines powered by nuclear energy, ships transporting radioactive substances, and ships arriving at the invitation of the Government of the Socialist Republic of Vietnam shall notify at least 24 hours. before the ship's estimated position arrives at the port. At least 12 hours from the time the ship is expected to arrive at the anchorage awaiting transit.

– Confirmation of ship arrival at port:

+ Ships arriving at the port's expected location 02 hours earlier or later than the time stated in the notice of ship's arrival at the seaport must notify the Port Authority of the exact time the ship arrives at the expected location according to the form. ;

+ In case a ship has sick people, dead people, people rescued at sea or people hiding on board, the ship must notify the Port Authority of the exact time the ship will arrive at the expected location, information about name, age, nationality, medical condition, reason of death and other related requirements according to the form.

– At least 02 hours after the ship has anchored at the wharf or 04 hours since the ship has anchored at other locations in the seaport waters according to the dispatch plan, the person carrying out the procedures submits the application. to carry out procedures for ships at the headquarters or the Port Authority Representative Office.

b) Resolving administrative procedures:

– Maritime port authorities are responsible for notifying relevant organizations of information about ships entering seaports and operating in Vietnam's waters according to regulations to carry out procedures and coordinate mobilization and deployment. ship reception.

+ Maritime port authorities process and resolve documents for ships, certificates of professional qualifications of seafarers and are the final decision-making body for ships entering seaports;

+ Border guards handle and resolve documents for crew members, passengers, stowaways, people hiding on the ship and people getting on and off the ship;

+ Border gate customs processes and resolves documents for goods, luggage, raw materials, and fuel on board ships.

– On the basis of the notification and confirmation of the ship's arrival at the port, at least 02 hours before the ship arrives at the expected destination, the Director of the Maritime Port Authority will base on the actual conditions, technical specifications of the ship, and type of ship. cargo, the port's dispatch plan, the pilot organization's ship navigation plan and opinions of state management agencies to consider and decide to approve ships entering the port through the sample dispatch plan; In case the ship is not approved to enter the port, the person carrying out the procedures must be notified and clearly state the reason.

– No later than 01 hour from the time the person carrying out the procedures has submitted and presented all the required documents, the state management agencies will process and resolve specialized procedures and notify the Port Authority. results and the Port Authority completes procedures; In case the ship has not completed the procedures, it must be notified and clearly state the reason.

2. How to do it:

– Send Ship Arrival Notice, ship arrival confirmation, ship's records and papers according to regulations by fax, electronic declaration, submitted directly or through the postal system.

– In case of electronic procedures: the person doing the procedures declares and sends documents through the Electronic Information Portal and does not have to submit or present documents at the procedure location. In case the declaration documents sent through the Electronic Information Portal do not meet the conditions of electronic documents or there is not enough electronic data to check and compare, the person carrying out the procedures must submit and present them at the work location. procedure.

3. Components and quantity of documents:

a) Document components:

– Documents sent by fax or email:

+ Notice of ship arrival at seaport (according to the General Declaration form);

+ Confirm ship arrival notice (if there is a change in port arrival time and other information as prescribed).

– Documents to be submitted (original), 01 copy of each type, including:

+ Submit to the maritime port authority: General declaration according to the form; List of crew members according to form; Passenger list (if any) according to the form; Dangerous goods declaration (if carrying imported or transited goods) according to form, Port departure permit;

+ Submit to the Border Guard: General declaration (for ships flying foreign flags) according to the form, List of crew members according to the form; List of passengers (if any) according to form, Declaration of weapons and explosives according to form, Declaration of people hiding on board according to form;

+ Submit to border gate customs: General declaration (if carrying imported or transit goods) according to the form, Crew list (if there are crew members with foreign nationality) according to the form, Cargo declaration (if any carrying imported or transit goods) according to the form, Dangerous goods declaration (if carrying imported or transit goods) according to the form, Ship's reserve declaration (if carrying imported or transit goods) according to the form , Declaration of taxable, prohibited or restricted luggage of passengers, crew members, and stowaways (if there are passengers or crew members with foreign nationality) according to the form.

– Documents that must be presented (originals), include:

+ Submit to the Maritime Port Authority: Certificate of ship registration, professional certificates of seafarers according to regulations, certificates of technical safety of ships according to regulations, crew book;

+ Present to the Border Guard: Passport of the crew member or valid international travel documents (if there is a crew member with foreign nationality);

+ When the relevant specialized state management agency requests to present: Passport, international vaccination card of the passenger (if any passenger has foreign nationality).

b) Number of documents: 01 set.

4. Time limit for resolution:

– No later than 01 hour from the time the person carrying out the procedures has submitted and presented all the required documents, the state management agencies will process and resolve specialized procedures and notify the Port Authority. results and the Port Authority completes the procedures.

5. Subjects performing administrative procedures:

Person carrying out procedures: is the ship owner or ship manager, charterer, ship operator, captain or authorized person who carries out declaration and procedures according to the provisions of this Decree with the agencies. State management at seaports.

6. Agencies implementing administrative procedures:

a) Authority with decision-making authority: Port Authority or Port Authority Representative.

b) Authority or competent person authorized or decentralized to implement: None.

c) Agencies directly implementing administrative procedures:

– Maritime Port Authority or Maritime Port Authority Representative;

– Border guards;

– Border customs.

d) Coordinating agency: Border guard, Border customs.

7. Results of implementing administrative procedures:

8. Fees and charges:

– Types of fees:

+ Ship and boat tonnage fee: according to the fee schedule specified in Article 7 of Circular No. 261/2016/TT-BTC dated November 14, 2016 of the Minister of Finance.

+ Maritime security fee: according to the fee schedule specified in Article 8 of Circular No. 261/2016/TT-BTC dated November 14, 2016 of the Minister of Finance.

+ Fees for using mooring positions in water areas and water areas: according to the fee schedule specified in Article 9 of Circular No. 261/2016/TT-BTC dated November 14, 2016 of the Minister of Finance.

– Seaport entrance fee: according to regulations in Article 11 of Circular No. 261/2016/TT-BTC dated November 14, 2016 of the Minister of Finance.

– Particularly in cases where ships operating on domestic routes do not carry imported goods or goods in transit but have passengers or crew members with foreign nationality entering the port: collect fees and charges according to the domestic fee schedule of Circular No. 261 /2016/TT-BTC dated November 14, 2016 of the Minister of Finance.

10. Requirements and conditions for implementing administrative procedures:

All types of ships are only allowed to enter seaports when they meet all conditions for maritime safety, maritime security, environmental pollution prevention and other conditions as prescribed by law.
