According to the Ministry of Industry and Trade, Circular 17/2022/TT-BCT has many new points, notably the addition of Article 3a on the duration of licenses to produce and trade chemicals restricted from production and trading in Vietnam. industrial sector.

Accordingly, the newly issued license has a validity period of 5 years from the date of issue. For persistent organic chemicals (POP), the license term is 5 years from the date of issue or equal to the exemption registration period specified in Decree No. 08/2022/ND-CP detailing regulations. some articles of the Law on Environmental Protection, based on whichever deadline comes first. The term of the reissued and adjusted license is equal to the remaining term of the issued license.

In addition, the circular amends regulations on general reporting of chemical activities of organizations and individuals engaged in chemical activities in the industrial sector.

Before February 15 every year (current regulations are before January 15 every year), organizations and individuals engaged in chemical activities in the industrial sector are responsible for reporting a summary of the situation of their chemical activities. last year came Department of chemistry (Ministry of Industry and Trade), Departments of Industry and Trade of provinces and centrally run cities where the headquarters and production and business locations are located through the National Chemical Database system (https:// chemicaldata.gov.vn/cms.xc).

Organizations and individuals engaged in chemical activities in the industrial sector are responsible for reporting when incidents occur in chemical activities or terminating chemical activities to the Department of Chemicals and Departments of Industry and Trade of provinces and cities. directly under the central government where the head office is located and where the production and business locations are located.

According to the provisions of Circular 17/2022/TT-BCT, before March 1 every year, the Departments of Industry and Trade of provinces and centrally run cities are responsible for reporting on the management of chemical activities of the organization. , individuals in the management area to the Department of Chemicals through the National Chemical Database system. The Circular takes effect from December 22, 2022.
