C/O Form EAV (Vietnam – Eurasian Economic Union)

 

1. Concept of C/O form EAV

Certificate of Origin C/O form EAV – (Certificate of Origin Form EAV) is an important document for goods exported from Vietnam to countries such as Armenia, Belarus, Kazakhstan, Kyrgyz, Russia. With this certificate of origin, exported goods will enjoy tax incentives under the VN-EAEU FTA agreement.

VN-EAEU FTA Agreement also known as Vietnam free trade agreement with the Eurasian Economic Union. The agreement was signed between Vietnam and member countries of the Eurasian Economic Union on May 29, 2015 in Kazakhstan. The agreement officially took effect from October 5, 2016.

 

2. Application for C/O form EAV

To apply for C/O form EAV, you need to prepare the following specific documents:

  • The application for C/O is filled out with complete and valid information.
  • C/O form EAV has been filled in with complete information along with the additional C/O declaration form (if any) (based on Appendix V issued with Circular No. 21/2016/TT-BCT dated September 20 /2016)
  • Printed copy of export customs declaration. If the exported goods do not require a customs declaration according to the provisions of law, there will be no need to submit a copy of the customs declaration.
  • Copy of commercial invoice (stamped as a copy of the original by the trader);
  • Copy of bill of lading or corresponding transport document (stamped as a copy of the original by the trader). If there is no bill of lading, the trader will be considered not to submit this document. But that is only in the case of exported goods using a form of delivery that does not use a bill of lading or transport documents as prescribed by law.

In addition, if you have not registered a trader profile according to the law before exporting goods, you need to register as a trader. The trader registration dossier will include:

  • Register the signature sample of the person authorized to sign the C/O issuance application and the trader's seal.
  • Copy of business registration certificate (stamped as true copy)
  • List of traders' production facilities.
  • Application to change the place of issuance of C/O.

3. Procedure for issuing C/O form EAV

When you have fully prepared the application for C/O form EAV. When your Certificate of Origin will be issued in the following specific order:

  • Step 1: Declare the trader registration application (if it is the first time) from the Ministry of Industry and Trade or you can submit the application directly at the headquarters of the origin certification organizations.
  • Step 2: You submit your application for C/O at www.ecosys.gov.vn Or you can submit an application for a C/O directly at the headquarters of the C/O issuing organization where you registered your trader profile. You can also send your application for a C/O by post if travel conditions do not allow it.
  • Step 3: The C/O issuing organization will check whether your application is valid and the information is correct. It will then notify you of one of the following:
    • C/O issued and time to receive C/O;
    • Request to add additional documents (specific documents that need to be added will also be notified);
    • Recommend to re-check the set of documents (announce the specific pieces of information that need to be checked if there is specific evidence and authentic grounds for this request for checking).
    • C/O will be refused if errors are detected as prescribed in Article 21 of Decree No. 31/2018/ND-CP dated March 8, 2018 of the Government on the management of goods origin. .
    • Recommend to re-inspect the production facility if necessary.
